Platform Liability Agreement
PLATFORM LIABILITY AGREEMENT

This document represents the rules of responsibility and confidentiality of the Platform, available at www.sherwinesuviniljuntos.com.br, owned by MoonWeb – Soluções Digitais, a private legal entity registered with CNPJ/MF under nº 13.120.792/0001-80, headquartered at Rua Rio Branco 192 – Bairro Vila Independência, city of Valinhos, state of São Paulo, ZIP code: 13276-250, for the purpose of holding the Sherwin Williams & Suvinil event.

BY USING THE Sherwin Williams & Suvinil PLATFORM, YOU AUTOMATICALLY AGREE TO THESE TERMS OF USE, TAKING FULL RESPONSIBILITY FOR ANY AND ALL ACTIONS PERFORMED BY YOU ON THE PLATFORM OR RELATED SERVICES. IF YOU DO NOT AGREE WITH ANY OF THE TERMS AND CONDITIONS SET FORTH BELOW, YOU MUST NOT USE THE PLATFORM.

Therefore, it is very important that, before proceeding, you carefully read this document. By confirming your registration on the Platform, you understand and accept all the provisions of this Liability Agreement. If, however, you do not agree with any provision of this document, we advise you not to create or use your access account on the Platform.

It should be noted that all intellectual property related to our platform is owned and used by the Company or its licensors, including materials protected by copyright, trademark rights, patent laws, and other intellectual property laws and international treaties. All trademarks, service marks, and trade names used in or related to the platforms are owned, registered, and/or licensed by the Company.

All content, data, and information on the platforms, including but not limited to text, software, scripts, code, designs, graphics, photos, sounds, music, videos, applications, interactive features, and any other type of content, data, information, and related intellectual property rights are the exclusive property of the Company and/or its licensors. All rights are reserved, and the user may not use any of these intellectual property rights beyond the scope expressly authorized in these terms.

Thus, you declare and acknowledge that:

  1. I am aware that the Platform will grant access to activities, events, information, and confidential data exclusively owned by Sherwin Williams & Suvinil.
  2. I declare that filming, photography, and unauthorized recording of the information made available through the Platform are expressly forbidden.
  3. I declare that the ownership and right of use of all information, including photographs, recordings, and videos obtained during the period of Platform activities, belong to Sherwin Williams & Suvinil.
  4. I undertake to maintain confidentiality of all information, data, documents, papers, images, and videos made available on the Platform, and any form of disclosure or exposure of such information is prohibited, especially through social media, photographic records, videos, and the like, under penalty of liability for any damages caused to Sherwin Williams & Suvinil.
  5. I agree that this Agreement should not be interpreted as granting or approving, whether express or implied, any intellectual property rights or licenses from Sherwin Williams & Suvinil.
  6. I further authorize the collection of personal data by the Platform for internal use, knowing that the collected data will not be distributed or shared without my authorization, in accordance with the relevant legislation.
  7. I acknowledge that, in the event of noncompliance with this instrument, especially in the case of disclosure by any means or form of confidential information received, I will be held liable for all losses and damages to be assessed, and Sherwin Williams & Suvinil may adopt any other available legal measures, including criminal action.
  8. UNDER NO CIRCUMSTANCES SHALL THE COMPANY, ITS DIRECTORS, OR EMPLOYEES BE LIABLE FOR ANY DAMAGES, WHETHER DIRECT OR INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL, LOSSES OR EXPENSES ARISING FROM CONNECTION WITH ITS PLATFORM OR USE OF ITS PART OR INABILITY TO USE BY ANY PARTY, AS WELL AS REGARDING ANY PERFORMANCE FAILURE, ERROR, OMISSION, INTERRUPTION, DEFECT, OR DELAY IN OPERATION OR TRANSMISSION, MALICIOUS CODE OR SYSTEM/CONNECTION FAILURE, EVEN IF THE COMPANY OR ITS REPRESENTATIVES ARE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, LOSSES, OR EXPENSES.
